The governor's legal action follows a judicial order that prevented the Trump administration from sending the state guard of Oregon to the city of Portland. US district judge Karin Immergut upheld assertions that it would intensify rather than ease unrest in the urban area.

The judge stated in her order, which postpones deploying the guard until at least October 18, that there was a absence of factual support that the current demonstrations in the city warranted the move.
